Terms and Conditions 

Company Information 

The Website is owned and operated by F A M M DISTRICT GENERAL TRADING L.L.C S.O.C and FAMM DISTRICT CAFE LLC a company registered in the Emirate of Dubai, United Arab Emirates, with its registered address at Warehouse C, Building 3, G03, Dubai Investment Park 2, Dubai, United Arab Emirates. The Company may be contacted through the channels listed in Contact Us.

Acceptance of Terms 

By accessing the Website, browsing its content, creating an Account or placing an Order, you confirm that you have read, understood and agree to be bound by this Manual in its entirety, together with any policy expressly referenced within it. If you do not agree to these terms, you must discontinue use of the Website immediately. Continued use of the Website following the publication of any amendment to this Manual constitutes acceptance of that amendment, in accordance with Terms and Conditions and Privacy Policy.

Website Use 

The Website and its content are made available for your personal, non-commercial use in connection with browsing FAMM Tableware and FAMM Café Products and placing Orders. You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party. The Company reserves the right, at its sole discretion, to restrict, suspend or terminate access to the Website, or any part of it, for any Customer who breaches this Manual.

User Accounts 

Certain features of the Website, including the placement of Orders, tracking of deliveries and the receipt of order confirmations, require the creation of a Customer account (an "Account"). You agree to provide accurate, current and complete information when creating an Account, and to update such information promptly following any change. The Company is not responsible for any loss arising from inaccurate or outdated Account information.

Account Security 

You are responsible for maintaining the confidentiality of your Account login credentials and for all activity that occurs under your Account, whether or not authorised by you. You agree to notify the Company immediately at customerservice@famm.ae of any unauthorised use of your Account or any other breach of security. The Company shall not be liable for any loss or damage arising from your failure to safeguard your Account credentials.

Age Restriction 

The Website and its Products are intended for use by persons who are at least eighteen (18) years of age. Users under the age of eighteen (18) may not register an Account, place an Order or otherwise transact on the Website, whether independently or through a third party acting on their behalf. By creating an Account or placing an Order, you represent and warrant that you are at least eighteen (18) years of age.

Orders 

An Order submitted through the Website constitutes an offer by the Customer to purchase the relevant Products, subject to acceptance by the Company. A contract of sale is formed only upon the Company's dispatch of an order confirmation, and not upon the Customer's submission of the Order or the Company's acknowledgement of receipt. The Company reserves the right to decline, cancel or limit any Order, in whole or in part, prior to dispatch of an order confirmation, including where a Product is unavailable, where a pricing or descriptive error has occurred, where fraud or attempted fraud is suspected, or where the Company is unable to verify the Customer's identity or payment details.

Pricing 

All prices displayed on the Website are quoted in AED and are inclusive of applicable UAE value added tax unless stated otherwise. The Company takes reasonable care to ensure that prices displayed on the Website are accurate at the time of publication; however, in the event of a manifest pricing error, the Company reserves the right to cancel the affected Order and issue a full refund, or to contact the Customer to confirm whether the Order should proceed at the correct price. The price payable for a Product is the price in force at the time the Order is placed, and the displayed price and currency at checkout will be identical to the amount reflected on the transaction receipt issued to the Customer.

Availability 

Products are offered subject to availability. Certain FAMM Tableware Products are produced or sourced in limited quantities, and certain FAMM Café Products are made to order or prepared fresh to a daily schedule; accordingly, availability may vary without notice. Where a Product becomes unavailable after an Order has been placed, the Company will notify the Customer and offer a substitute Product, a delayed delivery date, or a full refund, at the Customer's election.

Payment 

Payment for all Orders is processed in accordance with Payment Policy of this Manual. In summary: the Website accepts Visa and Mastercard debit and credit cards, all transactions are processed in AED, and a transaction receipt is issued to the Customer upon successful payment, reflecting the same price and currency shown at checkout. An Order is confirmed only upon successful authorisation of payment by the Customer's card issuer and receipt of payment confirmation by the Company. Full detail regarding accepted payment methods, failed payments, fraud prevention and chargebacks is set out in Payment Policy.

Product Information 

The Company endeavours to ensure that descriptions, images, dimensions, weights, colours and other particulars of Products displayed on the Website are accurate and presented in good faith. Owing to the handcrafted nature of many FAMM Tableware pieces and the handmade nature of FAMM Café bakery and patisserie items, minor variations in colour, finish, glaze, shape, decoration or texture between the Product as photographed and the Product as delivered are inherent to the category and do not constitute a defect. Screen and device display settings may also cause minor variation in perceived colour. Where such variation is material, the Customer may rely on the remedies set out in Exchange, Return and Refund Policy.

Limitation of Liability 

To the fullest extent permitted by the laws of the United Arab Emirates, the Company's liability to the Customer arising out of or in connection with the Website or any Order is limited to the price paid for the affected Product. The Company shall not be liable for any indirect, incidental, consequential or special loss, including loss of profit, loss of enjoyment or loss of data, arising out of or in connection with the use of the Website or the supply of Products, save where such liability cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Nothing in this Manual excludes or limits any right that the Customer holds as a consumer under mandatory UAE consumer protection legislation, including Federal Law No. 15 of 2020 on Consumer Protection and its executive regulations, and any right so preserved shall prevail over any conflicting provision of this Manual.

Intellectual Property 

All content appearing on the Website, including the FAMM name, logos, trademarks, photography, product design, packaging design, text, graphics and software, is the property of the Company or its licensors and is protected by UAE and international intellectual property laws. No licence is granted to reproduce, distribute, modify, publicly display or create derivative works from any content on the Website without the Company's prior written consent. Nothing in this Manual transfers ownership of any intellectual property right to the Customer.

User-Generated Content 

Where the Website or the Company's associated social media channels permit the submission of reviews, photographs, comments or other content by Customers ("User Content"), the Customer grants the Company a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt and publish such User Content for marketing, promotional and editorial purposes. The Customer warrants that any User Content submitted does not infringe the intellectual property, privacy or other rights of any third party, and is not defamatory, obscene, unlawful or otherwise objectionable. The Company reserves the right to remove any User Content at its sole discretion.

Prohibited Activities 

In using the Website, the Customer agrees not to: (a) attempt to gain unauthorised access to the Website, its servers, or any system or network connected to the Website; (b) introduce viruses, malware or other harmful code; (c) engage in any activity that interferes with or disrupts the Website or the servers or networks supporting it; (d) use automated means, including scrapers or bots, to access or extract data from the Website without prior written consent; (e) impersonate any person or entity or misrepresent an affiliation with any person or entity; (f) place fraudulent Orders or use stolen or unauthorised payment details; or (g) use the Website for any unlawful purpose. Breach of this Terms and Conditions entitles the Company to suspend or terminate the Customer's Account and to pursue any available legal remedy.

Third-Party Links 

The Website may contain links to third-party websites, including social media platforms, logistics partners and payment service providers. Such links are provided for convenience only. The Company does not control and is not responsible for the content, accuracy, or privacy practices of any third-party website, and the inclusion of a link does not imply endorsement. Privacy Policy sets out the Company's position on third-party websites in the context of privacy specifically.

Force Majeure 

The Company shall not be liable for any delay or failure in the performance of its obligations under this Manual where such delay or failure results from circumstances beyond its reasonable control, including acts of God, extreme weather, fire, flood, epidemic or pandemic, governmental action, import or export restriction, customs delay, strike or labour dispute, failure of a third-party carrier or logistics provider, or disruption to telecommunications or payment networks ("Force Majeure Event"). Performance of the affected obligation shall be suspended for the duration of the Force Majeure Event, and the Company will make reasonable efforts to notify affected Customers and to resume performance promptly once the Force Majeure Event has concluded.

Termination 

The Company may suspend or terminate a Customer's Account and access to the Website, without notice, where the Customer breaches this Manual, provides false information, engages in fraudulent or unlawful activity, or where the Company is required to do so by law or by a competent authority. A Customer may close their Account at any time by contacting customerservice@famm.ae. Termination does not affect any right, obligation or liability that has accrued prior to the date of termination, including obligations relating to Orders placed prior to termination.

Assignment 

The Customer may not assign, transfer or sub-contract any right or obligation under this Manual without the Company's prior written consent. The Company may assign, transfer or sub-contract any or all of its rights and obligations under this Manual to any affiliate, successor in business, or third party, including in connection with a merger, acquisition, restructuring or sale of assets, provided that such assignment does not materially diminish the Customer's rights under this Manual.

Governing Law 

This Manual, and any purchase, dispute or claim arising out of or in connection with the Website (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Dispute Resolution 

The Company encourages Customers to raise any concern in the first instance with Customer Service at customerservice@famm.ae, so that it may be resolved promptly and informally. Where a dispute cannot be resolved informally within a reasonable period, the courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Manual, the Website or any Order, without prejudice to any mandatory right of the Customer to bring proceedings before a competent UAE consumer protection authority.

Food Safety Policy

This Food Safety Policy applies to all FAMM Café Products and should be read together with FAMM Café Delivery Policy (FAMM Café Delivery Policy), Exchange, Return and Refund Policy (FAMM Café returns) and Allergy Disclaimer.

Freshness and Shelf Life 

FAMM Café Products are prepared fresh and are intended for consumption within a limited period following delivery or collection. Where practicable, the Company will indicate a recommended consumption period or best-before guidance for a Product on its packaging or in the order confirmation. In the absence of specific guidance, cakes, pastries and desserts containing fresh cream, custard or fresh fruit should ordinarily be consumed within twenty-four (24) to forty-eight (48) hours of delivery and stored under refrigeration throughout that period.

Storage and Refrigeration 

Perishable FAMM Café Products must be transferred to a domestic or commercial refrigerator promptly upon delivery, and in any event within a reasonable period appropriate to ambient temperature conditions, consistent with FAMM Café Delivery Policy and FAMM Café Delivery Policy. Products should be kept away from direct sunlight and heat sources both before and after refrigeration, and, where a Product is intended to be served at room temperature, it should be removed from refrigeration only shortly before serving.

Food Handling 

The Company prepares FAMM Café Products in accordance with applicable UAE food safety and hygiene regulations, including practices relating to staff hygiene, temperature control, and cross-contamination prevention appropriate to a bakery and patisserie kitchen. Notwithstanding these practices, Customers handling FAMM Café Products after delivery should observe ordinary food hygiene practice, including clean utensils and surfaces, and should not consume a Product that shows any sign of spoilage.

Consumption Guidance 

The Customer should consume FAMM Café Products within the recommended period described in Food Safety Policy and should not consume a Product that has been left unrefrigerated beyond a reasonable period, that shows visible signs of spoilage, or that has been stored in a manner inconsistent with Food Safety Policy. Where a Customer has any doubt as to the continued safety of a Product, the Company recommends that the Product not be consumed.

Customer Responsibilities 

Consistent with FAMM Café Delivery Policy and Exchange, Return and Refund Policy, the Customer bears responsibility for the proper storage, refrigeration and handling of a FAMM Café Product following delivery and acceptance. The Company cannot be held responsible for illness, deterioration or dissatisfaction arising from storage, handling or consumption practices outside its control, without prejudice to the Customer's rights in respect of a Product that was unsafe at the time of delivery, as described in Exchange, Return and Refund Policy(d), or the Customer's mandatory rights under Exchange, Return and Refund Policy.

 

Allergy Disclaimer

Allergen Information 

FAMM Café prepares and handles Products containing, or made using ingredients derived from, common allergens, including gluten, milk, eggs, tree nuts, peanuts, soy, sesame and shellfish. Where reasonably practicable, the Company will identify known allergens present in a Product on the Website, on packaging, or on request from Customer Service. Customers with a known allergy or intolerance must review the available allergen information carefully and must contact Customer Service before placing an Order if any doubt remains regarding the presence of a particular allergen.

Cross-Contamination 

FAMM Café Products are prepared in a shared kitchen environment in which multiple allergens, including gluten, milk, eggs, tree nuts, peanuts, soy, sesame and shellfish, are present and handled. Despite the Company's food handling practices described in Food Safety Policy, the Company cannot guarantee that any Product is entirely free from trace amounts of any allergen as a result of shared equipment, shared preparation surfaces, or shared airborne particles within the kitchen environment.

No Guarantee of Allergen-Free Environment 

The Company does not represent or warrant that any FAMM Café Product, including a Product marketed or labelled as free from a particular allergen (such as gluten-free or nut-free), is prepared in a wholly allergen-free environment. Customers with a severe allergy, anaphylaxis risk, or other condition where trace cross-contamination could result in a serious reaction should exercise particular caution and are strongly encouraged to contact Customer Service to discuss their requirements before placing an Order.

Customer Responsibility for Disclosure 

The Customer is responsible for disclosing any known allergy, intolerance or dietary requirement to Customer Service at the time of Order, in accordance with Exchange, Return and Refund Policy. The Company's ability to accommodate a dietary requirement is limited to the information disclosed by the Customer, and the Company cannot be responsible for a reaction arising from an allergy or intolerance that was not disclosed at the time of Order.
